Who can claim?
Any road user including a driver, passenger, pedestrian, cyclist, and/or motorcyclist can make a claim if they can show that the other driver was at fault (either wholly or partially).

Even if you were partly at fault for the accident and your injuries, you may be able to make a claim. However, any compensation you receive may be reduced.

In an accident where a driver is not at fault?
A blameless accident is defined as a motor accident not caused by the fault of the owner or driver of any motor vehicle involved in the accident in the use or operation of the vehicle and not caused by the fault of any other person. (Section 7A of the Motor Accidents Compensation Act)

This can include:

  • Accidents caused by a driver who suffered a sudden illness (such as a heart attack)
  • Accidents caused by an unexplained mechanical or vehicle failure
  • Accidents caused by an unavoidable collision with an animal

Any road user can make a claim for a blameless accident. Though, there are some limits that apply to an injured driver in blameless accidents, for example, you may not be able to claim if it was a single vehicle accident or if you were driving the vehicle that caused the accident.

What to do:

  • Report the accident to the police within 48 hours and get a police "event number";
  • Make an appointment at Barwick Boitano Lawyers within 6 months of the accident to complete a claim form;
