Accidents in Public Places - NSW Compensation

Accidents can happen and people can be hurt not just on the way to and from work or at work or on the road but also in public places, supermarkets or shopping centres, hotels, night clubs, sporting matches, at schools, on the footpath, or other people can even inflict injury on you through carelessness trespass to your person or even through dog or other animal attacks.

  • Whilst playing sport or other recreational activities there are times when you will also be entitled to claim compensation for injuries that could have been avoided if all reasonable care was taken for your safety.

  • Even if you have been detained against your will, which is sometimes referred to as false imprisonment you may be entitled to bring a claim.

  • Claims of this nature in New South Wales are covered by the Civil Liability Act 2002.

  • $450,000.00 under Section 16 for 100% * of the most extreme case just for general damages (pain and suffering) can be awarded under that Act.

  • The $450,000.00 does not include any claims that you may have for loss of wages

  • You can claim loss of superannuation entitlements

  • You can claim medical expenses including the cost of operations for the past and the future

  • There are very strict time limits that apply in bringing these claims - you must make claims within three years of the injuries occurring. This also applies even if you are under the age of eighteen.

  • You will need an Accredited Specialist in Personal Injury Law to help you with these claims and get the maximum amount under the Law.

  • Accredited Specialists in Personal Injury Law can gather the information to support your claim, send out notices so that the claim can be made to the owners or occupiers of properties and insurers and get offers of settlement and assess the value of your claim. If they can't settle an Accredited Specialist in Personal Injury Law will assist you in commencing Court proceedings to obtain the maximum entitlements available to you and offer a no win/no pay fee* agreement.

*This amount is adjusted (indexed) once per year and as 1 October, 2007 is $450,000.00.
